Background Information:
In October 2017 Stephen Paddock, an alleged shooter, smashed out windows of his 32nd floor suite in the Mandalay Bay Hotel in Las Vegas and fired a barrage of bullets from a semi-automatic weapon, bringing death and terror to the more than 22,000 attendees of the outdoor country music Route 91 Harvest Festival during the closing set of artist Jason Aldean. Ten minutes of sporadic shooting killed 58 people, injured more than 500 others, and induced a stampede by concertgoers, in what was, with that assault, the deadliest mass shooting in the United States.
The promoter, Live Nation, is: the world’s largest live promoter, drawing 550 million fans to events in 40 different countries; the world’s largest network for advertising for brands; owner of the world’s largest ticketing agency, Ticketmaster; and the world’s largest talent management company, servicing more than 500 clients.
Live Nation has concerns about liability, a decrease in future festival attendance and, consequently, a potential decrease in sponsorship/partnership/advertising revenue. Aldean, a two-time Academy of Country Music (ACM) Entertainer of the Year, has sold more than 15 million albums, reached no. 1 on the country charts 17 times and, at the time of the shooting, had an additional 10 dates left on his 2017 tour of more than 60 scheduled dates. Immediately following the massacre, out of respect for the victims, he cancelled a week’s worth of performances. Both he and his management company have concerns similar to Live Nation regarding potential liability. Mandalay Bay Hotel, owned by MGM Resorts International, has more than 3,300 rooms and a 12,000-seat Events Center that stages live performances. In addition to Live Nation and Aldean, MGM Resorts International is worried about the effect this tragedy will have on its various other businesses.
