According to the SPLC complaint they have been in contact with an individual who has been on death row for 22 years and just last year had an execution date set. However, as the state started the execution process they were unable to complete the execution due to a variety of reasons (inability to secure the needles for administration, one of the correctional officers had a medical episode, and a technical issue shut down the power for 20 minutes) and as a result the individual was returned to his cell. With the setting of this new execution date the SPLC and this individual’s attorney are claiming that the state had their chance to carry out his death sentence and they failed to do so in a legally correct manner. As such they are claiming that their client is being subjected to multiple punishments beyond that which he was sentenced to – the death penalty that he has already faced and survived. As such they are asking you to stop the upcoming execution on the grounds of it being unconstitutional. Using some historical resources to trace the development of the cruel and unusual punishment legal doctrine in the United States, form an argument for Governor WANNA that either supports their legal decision that the execution should go forward or an argument that counters their legal decision and argues that the second execution date is an example of cruel and unusual punishment.
