Background
In this lesson, you examined some of the most litigious areas of special education law. Special education directors and school administrators must have a strong understanding of the basic principles of IDEA, as well as the procedures for parents who believe that the needs of their child are not being met.
You will conduct an interview of either a school administrator or a special education director to learn more about FAPE and due process. Make sure that you change the site name and any information that may disclose your interviewee when writing your overview. Before you conduct your interview, you should prepare a set of questions focused on the following topics:
The responsibilities and requirements in providing a FAPE
The school’s/state’s process for parent complaints about special education services, from filing a complaint through the due process hearing
Any recent litigation that has occurred regarding IDEA (Please note that school officials cannot discuss cases that are currently being litigated, but they may be able to speak in generalities about past issues or address cases that are on the public record)
Concerns with application of special education law
