TEACHERS INSTRUCTIONS: “Each student will prepare a 1-4 page doubled spaced typed paper (12 font). The paper will have a title page and reference page, which are not counted when meeting the minimum number of required pages. While special attachments to the paper may enhance the students’ efforts, they do not help meet the length requirement.
Papers will conform to either APA or MLA standards (references).
Student papers will be structured as follows:
-summarize the case
-identify what you felt the most significant evidence used, or ruled out was
-Discuss the appropriate rules of evidence using the evidence code.
-Disscuss what the suspects were charged with
-Finally, the student will offer their opinion as to the finding of the court.
Students are to use appendix B in their textbook when referring to the rules of evidence.
TEACHERS EXAMPLE: (Students may not use this example) = the student chose to do the double homicide case concerning the “Mendez” brothers. After summarizing the event the student might discuss the testimony of their psychiatrists who told the jury that the brothers had confessed to him that they had intentionally killed their parents. The student would explain that under “Article V, rule 501”, that testimony should not be allowed because it is considered to be a “privileged” communication, which is protected from revelation. The student would then go on to explain that because the brothers threatened the doctor’s life, and he felt like his life was in danger, the communication was necessary to be brought out for the doctor’s safety sake. This in fact, is an exception to the general rule of privileged communications. Finally, the student would produce their opinion on whether the court acted properly by allowing the privileged conversation to admitted into testimony.”
