While leaving a grocery store after work in the evening, he sees three men standing near his car in the store parking lot. As he approaches his car, the three men turn and stare at him. Jack is now near panic fearing an attack, robbery or car jacking. He takes out his legal concealed carry pistol and fires hitting one man in the chest – not fatal but serious. Jack is arrested for attempted murder. The three men state that they were not about to harm Jack. They were looking for a lost wallet that one had dropped in the store parking lot in that area 30 minutes earlier. Jack’s attorney decides to use the Urban Survival Defense.
