Preparing for the Meeting with the Attorney
Both Becky and you after having read the material on legal rights has decided that a consultation with a lawyer to make sure she is protected before she opens the store is in order.
Directions:
Prepare a list of twelve (12) questions, three (3) for each of the four (4) major areas discussed in this week’s content that you would like to ask the lawyer. Be specific about how your questions might affect your chosen business and what steps you could take to minimize problems.
Select one (1) question from each of the four (4) areas. Write your answer as you imagine your attorney would based on the likely advice he or she would offer. This would include a discussion of the kinds of steps needed to prevent or reduce legal risk.
SCENARIO
Betsy and Luis met at their monthly meeting before Betsy was to have the Grand Opening of her Store online. Betsy asked Luis, “Is there anything else you can think of that I should be looking into before I launch my website?”, Luis replied, “Betsy did you see the ruling on the Amazon case about product liability? Did you know you can be held responsible for products that do not perform their purpose or are designed in a harmful way? The ruling says that unless you have clear terms spelled out in the online descriiption as to what the store is liable for the customer can hold you responsible.” Betsy was shocked. She never thought that she as the seller, not the manufacturer or distributor could bring the responsibility for a poorly made product on her shoulders. Luis went on to say, “You should also look into the contract, privacy issues and intellectual property rights (copyright, trademark, licensing, etc.) that could affect her daily business.” Betsy went immediately home after the meeting to start her research.
For managers running e-commerce businesses, legal infractions can come in many forms, with each infraction presenting a different challenge for the business. As such, it is vital for every e-commerce manager to know their legal responsibilities. There are four major areas of concern that every manager should have a working understanding of the legal issues customer privacy rights, contract formation, and enforcement, and intellectual property rights.
Amazon, easily the most recognizable face of the e-commerce industry, has had to navigate the treacherous world of regulation for years. Last year, the company survived a $2 million-dollar lawsuit after a U.S. District Court ruled that the company was not liable for products sold on its website after an online buyer sued the company for injuries sustained by a defective coffeemaker bought from Amazon.com. Here are a few articles that Betsy uncovered. Always remember that Google does not replace the best advice a lawyer can provide. It is important for a manager to recognize the potential for legal problems and take proactive steps to provide to avoid the risks. Knowing when to use a lawyer to help is important. Taking the steps to minimize risk before a lawsuit happens is always best for any business.
POWER POINT (BUSINESS PLAN)
Purpose:
The purpose of this project is for students to understand the business functions and concerns needed to set up an e-commerce business. In order to do this, the student must apply the concepts of managing a small e-commerce business to an actual business they for use in the real world. The business plan sets out in writing just how the business will function and why choices were made to so for success.
In completing this project, you will:
Explain all the elements of the business plan as they apply to the student’s business.
Explain the nature of the business, the customer, market, competitors, risks and value the business brings to the customer.

Descriiption:
Student will create a PowerPoint using the following information for slides and topics. In completing the project, you will use the course material and research on your business selection. You will use these resources to support the reasoning and conclusions presented.

Note Section: All slides will include an explanation of the topics discussed in the notes section of the PowerPoint presentation. The support for the explanations will come from the class material and will include in-text citations and a reference list.
The crux of this project is the use of the course material to respond to the requirements. Although it is important to create a great PowerPoint, the presentation does not count as much as what is contained in the presentation.
PowerPoint Elements:
You will create no more than 4 slides. Slides will consist of:
Slides 2-6: Using a separate slide for each element, explain each component of your business plan. The SWOT analysis should have its own slide and explanation.
Slides: The presentation is not a slide show of pictures so avoid cluttering the slides with pictures and images. Think of this as a presentation you would submit to executives. You want everyone to walk away with a good impression of your work. Start thinking of yourself as a brand that you want to promote! The work you perform is what people will associate with you when they think of your name. Do you want to be perceived as professional, an expert or one who cannot be taken seriously? Create a terrific presentation!
Plan your slides on paper before you create them in PowerPoint. Make sure the slides do not present information overload. Only present the information that the audience needs to hear. The rest will be presented in the Speaker Notes.
Speaker Notes Section: The crux of this assignment is presented in the Speaker Notes section of the PowerPoint presentation. The Speaker Notes provides the analysis, which means you will be explaining the information presented on the slides. Every slide needs a Speaker Note. The analysis has to be thoroughly presented with an explanation of ‘why and how’ that is supported by the research and course material. Do not skimp on the support since it is needed to demonstrate critical thinking and an understanding of what is presented. It is like writing a paper but placing the analysis in the slide notes [Note: A couple of sentences probably will not suffice as meeting the minimum on this project].
Speaker Notes can be accessed by opening a PowerPoint presentation and clicking on Notes at the bottom of the screen on the right side. Click into the Notes and type. It is probably advantageous to create the narrative first and then paste it into the Speaker Notes Section.
Submit the paper in the Assignment Folder (The assignment submitted to the Assignment Folder will be considered the student’s final product and therefore ready for grading by the instructor. It is incumbent upon the student to verify the assignment is the correct submission. No exceptions will be considered by the instructor).
Presentation Requirements
Use the grading rubric while completing the project to ensure all requirements are met that will lead to the highest possible grade.
Third-person writing is required. Third-person means that there are no words such as “I, me, my, we, or us” (first-person writing), nor is there use of “you or your” (second person writing).
Contractions are not used in business writing, so do not use them.
For all other source material used in the analysis, you will not use direct quotation marks but will instead paraphrase. What this means is that you will put the ideas of an author or article into your own words rather than lifting directly from a source document. You may not use more than four consecutive words from a source document, as doing so would require direct quotation marks. This requirement includes facts from the case scenario. Changing words from a passage does not exclude the passage from having quotation marks.
Use in-text citations and provide a reference list that contains the reference associated with each in-text citation.
You may not use books for completing this project.
Provide the page or paragraph number in every in-text citation presented. When using an eBook from the classroom, you will see that there are no page numbers so you will provide the Chapter Name and Section Title.
