First, read the two opinions in Ontario v Quon the opinions are from the US Supreme Court (2010) and the 9th Circuit Court of Appeals (2008). Take notes as you read. See Quon here.
Second, Read B Murrills essay on Modes of Constitutional Interpretation (Congressional Research Service). See pages 5-12 (The topics are: Textualism, Original Meaning and Precedent). Look for one mode of interpretation that you see in action in both Quon decisions. See Murrill here.
Third, read Baums discussion of policymaking in the Supreme Court. See Baum Here
