For this assignment you will provide a critical analysis and a critical breakdown of the case Chimel v. California. You will apply the learnings that you have gotten from this course to this analysis.
You will apply what you have learned throughout chapter 1 wherein we talked about the inner workings of the legal system and federalism. We also had a discussion on the court system so be sure to include this within your analysis. You will discuss this chapter within your critical analysis.
In addition to this, you will discuss chapter 2, which was an introduction to criminal law. In this chapter we learned about how criminal law works within the criminal procedural context and why we punish. You apply these concepts within your paper which require that you think beyond what is written within the case.
In addition to the above, you will discuss chapter 3 principles as well. The bulk of chapter 3 covered Mens Rea and Actus Reus, so you will cover those as it pertains to Chimel and break down the crimes charged and their requisite Mens Rea and Actus Reus to show that you understand the concepts that we have covered in chapter 3.
You will also include chapter 4 principles of burglary as they relate to the case Chimel. Provide your critical analysis of burglary, why a burglary should or should not have been charged here (ignore the 4th amendment concepts because we have not made it here yet).
This will be your first formal grade for this course, for those who want to know where they stand within the course, this will provide that measurement, so do your best work.
