In this Legal Aspects of Evidence class we take a critical look at evidence and not only determine what is evidence, but how we legally use it to make arrest and prosecute cases in criminal court. The United States use the American Adversary system in criminal trials. Your task is to write a term paper that deals specifically with the adversary system and demonstrate your knowledge regarding the process and consider if the system is equity based.
In this term paper you should carefully review the chapters and reflect on the contents to assist you with the preparation of your term paper.
Your paper should be authentic and represent college level writing. Your paper is designed to critically reflect on and have scholarly research information that contributes to our American Adversary system. The paper should answer and/ or demonstrate your knowledge of the following information:
A comprehensive definition of the Adversary system here in the United States of America.
Scholarly research that compares our adversary system to other systems in other parts of the world.
The difference between the accusatorial and adversary system.
Do you believe the adversary system based on our accusatory process is fair to those on trial (explain your response).
Examine relevant, reliable and competent evidence and articulate how it plays a role in the adversarial system and give at least two examples.
Conclude your paper with giving an overview on the accusatorial process. Incorporate the rest of your studies from this text book and offer your critical reflection and thoughts regarding this accusatorial style.
