(1) Explain how should or should not morality, in and of itself, be considered a sufficient basis for defining particular conduct as criminal; (2) Differentiate between civil law and criminal law; and explain why do they overlap; (3) Analyze the difference between substantive law and procedural law, including an example of each; (4) Explain the concept of federalism and how it complicates the administration of criminal justice in the U.S.; and, (5) explain how does the doctrine of judicial review affect the power of a state legislature to define criminal conduct. How would the constitutional limitations on legislative power be effective without the power of courts to declare laws unconstitutional.
