You are limited to 1000 words (you can go over 5% of the word count) (including headings and footnotes). Limit your consideration of the law to the material contained in your 141 Casebook and 141 Lectures. Please cite legal materials in manner that is consisted with the 141 Abridged Style Guide (available in Canvas).
Marking Criteria
You are expected to:
(a) Identify the misapplication(s) of the law in the judgment;
(b) Explain the correct and relevant legal standards that ought to have been applied;
(c) Evaluate whether an appellate court is likely to overturn the judgment on the grounds of appeal that you have identified; and
(d) Articulate the legal analysis in a clear, logically structured, and appropriately referenced, manner.
There is a typo in Assignment One. At paragraph [16] of the judgment is states that:
[16] The first fundamental similarity is that both courts were equally differential to the Legislature.
It should read:
[16] The first fundamental similarity is that both courts were equally deferential to the Legislature.
