Explain the constitutional rights that protect a criminally accused defendant during a trial.
Discuss the Supreme Court cases of Gideon v Wainwright and Strickland v. Washington and how those decisions impact the defendant’s rights at trial.
Explain how the work that police do, and the evidence that police provide to the prosecutor, could lead to injustice in the trial process.
Finally, address how prosecutorial misconduct (based on police misconduct during an investigation) might impact the defendant’s trial. Be sure to provide an example, fictional or real, describing how this might occur, and what the defendant’s “remedy” for such misconduct might be. Be sure to explore the appeals process as part of this answer.
