Local school boards are administrative agencies and they make decisions that impact our lives and our children’s lives directly. They make decisions as to book censorships, student disciplinary processes, internal rules/regulations on operation of school buildings, course approvals, etc. They often create regulations involving the operations of public and charter schools. Parents and other affected parties can challenge such decisions within the school board’s own internal complaint and resolution processes. However, once the petitioners in such school board administrative disputes exhaust all lower level remedies and receives a final school board decision on the matter, they can file an action in the court system to appeal the school board’s action, inaction or decision. One such case went all the way up to the US Supreme Court and dealt with a school board’s decision to NOT segregate its student body and prevent African America students from attending the same school as white students. The students parents challenged such “separate but equal” school board policies as violations of the equal protection clause in the 5th and 14th amendments.
