Part A: problem Question.
Bob operates a market stall at Thamespool’s local market. Thamespool Local Council is solely responsible for considering, issuing and revoking permits to stall operators. On 1st June 2023 the Council receives a written complaint alleging that Bob has been expressing deeply offensive political views to customers. Without allowing Bob to refute these allegations, see the evidence or attend an official hearing, Thamespool Local Council revokes his permit. Bob is distraught and wishes to challenge the Council’s decision. He believes he is being unfairly targeted because of his political views and that the decision will have a chilling effect upon free speech.
Bob now seeks to sue Thamespool Local Council for their decision which he believes was
unjustified and unlawful. Two options that have been suggested to him are judicial review and
using the Human Rights Act (HRA) 1998, but he is unsure on the correct procedure of these
legal mechanisms which he must follow and what exactly he should argue in court.
Advise Bob of the following:
• The procedure for launching a judicial review challenge (including the HRA 1998
mechanism) in administrative law.
• The relevant grounds of review for a judicial review challenge (including arguments
under the HRA 1998) he should pursue.
• The relevant remedies he should pursue for a judicial review challenge (including any
