A “fundamental liberty” is a term used to describe the most highly protected rights under the Constitution. As an example, the Court has identified marriage, procreation, consensual adult sexual activity, and travel, among others, as fundamental rights. Under the Equal Protection Clause, if the government engages in discrimination that interferes with a fundamental right, it must satisfy the strict scrutiny test before such discrimination is found constitutional.
