Consider the landmark Supreme Court cases we discussed in class. In each case, the Court protected a right or discarded a right. However, none of these rights are specifically mentioned in the U.S. Constitution. The law deciding each issue came from case law, or the interpretation of the Constitution by the Supreme Court justices.
What do you think about how these laws are created? Does the Court go too far in connecting a specific act to the Constitution? Or would it be better that the justices work with only what is expressly in the Constitution?
