In 1991, Rik Scarce was a graduate student at Washington State University with longtime interests in radical social movements. Scarce was conducting research on animal rights activist groups for his graduate degree. He developed relationships with animal rights activists as he was conducting his research.

Scarce asked a former research participant to house-sit while on vacation. While Scarce was on vacation, animal research facilities on campus were vandalized and animals were stolen or “liberated.” The person who was house sitting for Scarce was on television supporting animal rights, and he was suspected by authorities of being involved in the incident.

Scarce learns of the incident upon return from his trip and discusses it with the house-sitter. Authorities want Scarce to reveal the nature of his conversations with the house sitter as well as other people connected to the house sitter. Scarce considers his research confidential and does not want to answer questions. After months of refusing to testify before a grand jury, Scarce agrees to answer questions relating to what he considers non-confidential (e.g., non-research) information. However, citing the then existing ASA Code of Ethics (1989), he refuses to answer other questions that pertain to his research. Scarce is jailed for more than four months under a contempt order.
