The Fourth Amendment of the US Constitution prohibits unreasonable searches and seizures. It limits authority so you are guaranteed to be secure in your person, houses, papers, and effects. The only way law enforcement can legally search your or your belongings is with a search warrant, probable cause where a search warrant is not necessary, or during exigent circumstances. However, probable cause has to exist at each level. The only exception to this rule is when someone gives consent, and probable cause is not needed when someone consents to a search.
If evidence is obtained illegally, without probable cause, a warrant, or consent, it is not allowed to be entered as evidence. This is where we met the Exclusionary Rule. Just like every rule and law, there are exceptions.
