There are multiple defenses to intentional torts. List 5 of them, and then look at the following scenario.
James is a bus driver. He picks up the kids on his high school route at 3PM. About five minutes into his route, two students on his bus began to argue. James told them that he would not tolerate fighting on his bus and told the students to stop talking and looking at each other. The students continued their disagreement via text messages. James thought the argument was over, but suddenly, the students were shouting at each other and threatening to beat each other up. Seeing the police department ahead on the street, James pulled the bus into the parking lot and made the students who were fighting get off the bus and drove away with the rest of the students to take them home.
One of the parents of the fighting students told James he would sue him for false imprisonment of his student. James said there was no way the parent would win that case because he had a good defense.
Does James have a good defense? Which one of the defenses of intentional torts might apply, and is James right?
