To effectively execute their executive, quasi-legislative, and quasi-judicial functions, agencies require information. Information is crucial to, among other things, effective rulemaking and regulating by agencies. Central to obtaining information are the requirements placed upon individuals and businesses to produce and maintain records. However, the needs of government agencies to obtain information from individuals and businesses must be weighed against the strongly held American belief that individuals should be free from excessive government interference. The Fifth Amendment plays a crucial role in balancing the government’s need for information and an individual’s right to privacy.
While agencies require records to be saved or made available for review, courts have outlined that these recordkeeping and reporting requirements cannot be unduly burdensome or harmful. In addition to the protections outlined by the courts against burdensome or harmful recordkeeping and reporting, the Fifth Amendment provides individualized protections against self-incrimination. Notably, the government cannot force individuals to provide information that could be used to prove their guilt. While limitations to the Fifth Amendment protections against self-incrimination exist, the government may overcome the privilege of self-incrimination by granting immunity. Three types of immunities exist: transactional, derivative use, and use immunity.
