It appears that philosophers who hold a contractarian view feel that rights stem from a collective social decision and that these rights gain their power by the fact that they are important enough to be protected by law or social sanction. Theorists like Thomas Aquinas feel that rights exist before society and come from sources such as a consequence of Gods creation. These are two very different orientations to rights.
