1. The foundation of US wildlife law is based on the Public Trust doctrine. Describe the basic rationale of the doctrine and its origins. Then describe the potential problems or controversy with this doctrine. (20 pts) See attached pdf article for help on public trust.
2. Week One examined the nature of the US legal system. There is a great difference between the standards of proof for a criminal offense and a civil offense. What are the two standards of proof? Define each of these. Why is the criminal standard so high and the civil standard far lower. (10 pts)
3. This is a critical thinking question. If you own land that has wetlands (marsh, pond, stream or small lake) on it, those wetlands may be subject to regulation by the federal government. That is, you might be prohibited from altering them or draining them in order to use the land for farming or building. Do you think the federal government should have this authority? Why of why not? (10 pts)
