BACKGROUND OF ASSIGNMENT:

So, the class has been working on one case since the beginning of the term. We are now on our 3rd assignment involving this case. We started with a hypothetical case regarding foreign victims involved in a sex trafficking scandal. One of two culprits has been detained and stated that he will testify in court if law enforcement can guarantee the victims safety. The directions are as follows:
We were to research two potential visas available to the victims in this case — the T visa for victims of human trafficking and the U visa for victims of criminal activity. You will need to apply the law to the facts of the case and determine which one would be the best option for these victims. For this assignment, focus on immigration issues.
Once I have determined the immigration issues and the correct visa for the victims I was to write an interoffice memorandum. We are to assume the victims have no legal issues or outstanding criminal history and only refer to federal law.
The second assignment was a case brief. While the hypothetical case can not be cited, I was to brief a real case related to the plea deal and/or admission of Maximillian Smith. Which is much lesser time than the head of the operation. For this assignment, I was to brief a case using the FIRAC method. I was not writing a brief for the court, just briefing a single case for interoffice use.

And now for this assignment I am to prepare an internal legal memorandum regarding the culprit that is willing to testify, (Maximillian) and his live interview he did regarding the case. I do not have any description of context from this interview, so I assume this is just a way to keep all bases covered for court purposes and not be swayed by the defense to look crooked in the judges eyes.
Maximillian Smith’s attorney has filed a motion to prevent your office from admitting his television interview into evidence at trial. Your supervising attorney has asked you to research whether or not the statements he made in the television interview are admissible. Prepare the first draft of an internal legal memorandum outlining your research and conclusion.
Tips:
Identify the issue that needs to be researched. Do not get sidetracked by collateral issues. Your assignment is to research the admissibility issue presented. There may be other collateral issues, but they are outside the scope of your assignment.
Assume Maximillian Smith has no additional outstanding criminal or civil issues.
As this case is in federal court, you will use federal law to back your suggested conclusion.
Again this is a hypothetical case so there will not be a citation for the case itself, but I will need some federal laws/rules incorporated that help my side of the case. And for these rules the bluebook citation is to be included as in text citations and it must be written in the FIRAC method also in a 3rd person perspective.
