In this second assignment, students will apply the Chapter 7 material on judges, Chapter 8 material on defendants and victims, Chapter 9 material on juries, Chapter 10 material on pretrial procedures, Chapter 11 material on criminal trials, and the Chapter 12 material on sentencing in a hypothetical criminal case. Despite your best efforts to have the case dropped, the prosecution is continuing to pursue a case against your client. Help the defendant understand what is happening by addressing each of the following: Introduction and Defendant Rights: Begin your briefing with a paragraph explaining the importance of this topic. Specifically, you should tell your client why it is important for defendants to understand court procedures. Remember to cite your arguments (this is not your opinion but rather a research driven argument). Next, you will need to let your client know about his/her rights as the defendant. Pretrial: Explain the pretrial process to your client. Your response should be thorough and should demonstrate a familiarity with the course material by citing facts/information from the textbook (and scholarly sources if applicable). In addition to summarizing the course content, remember to apply this information to your unique case. How might the unique circumstances surrounding your client’s case shape important pretrial decisions? Trial and Evidence: Explain criminal court procedures to your client. Make sure that the defendant knows what to expect as well as the types of evidence that will likely be introduced during the trial. Your response should be thorough and should demonstrate a familiarity with the course material by citing facts/information from the textbook (and scholarly sources if applicable). In addition to summarizing the course content, remember to apply this information to your unique case. What are some of the specific types of evidence that would be introduced in your defendant’s trial? Judge, Jury, Sentencing, and Conclusion: Tell your client about the roles and responsibilities of the judge and jury. Finally, conclude your briefing with a discussion of what might happen if your client is convicted. Specifically, you should explain the sentencing process to the defendant. Tell the defendant whether your jurisdiction uses determinate or indeterminate sentencing structures, whether the jurisdiction relies on sentencing guidelines, and whether there are any mandatory sentencing laws that he/she should be aware of (since this is a fictional case, you may choose whichever structure(s) you like). Make sure to define these structures to your client. Your response should be thorough and should demonstrate a familiarity with the course material by citing facts/information from the textbook (and scholarly sources if applicable). In addition to summarizing the course content, remember to apply this information to your unique case. Based on what we know about the relationship between defendant characteristics and sentence outcomes, is your client more likely to receive a harsher or more lenient sentence outcome? Explain why with supporting evidence from the readings/commentaries and film/series/case.
