You are the mayor of a municipality. The municipal governing body has voted to exclude members of the public from a discussion at a regular meeting of the governing body concerning contracts with labor unions and to retire to executive session. The labor unions leave the meeting in protest but later request a copy of the minutes from the governing body’s executive session. You were not in the executive session, but members of your administration (including the chief financial officer, business administrator, and corporation counsel) advised the governing body on its options and made recommendations. The chairperson of the governing body’s finance committee advised you on what took place in the meeting and the consensus of the governing body. One labor union represents middle management and has endorsed your bid for reelection and made contributions to your campaign as well as to some members of the governing body. You are asked privately by a union leader from that union how much of a raise the union can expect, what givebacks is the municipality really looking for, and the city’s bottom line on negotiations. You are also asked what took place in the governing body’s executive session. The union leader saw a newscast in which a member of the governing body who did not receive the union’s endorsement for reelection discussed portions of the governing body’s closed session that were not favorable to the union’s goal of achieving a pay raise. This member of the governing body did so contrary to the advice of the corporation counsel. As the mayor you are the appointing authority of the members of the middle management union and execute the labor contracts on behalf of the municipality.

Consider the impact your decision will have on municipal finances, negotiations with other labor unions, and your own reelection.
Apply the applicable general laws to the facts and issues raised in the fact pattern, including the Open Public Meetings Act, Open Public Records Act, Local Government Ethics Law, and Pay-to-Play Law.
Discuss the theories of ethics and morals from the vantage point of all major actors in the fact pattern.
