Judicial Independence is commonly depicted as the foundational rule of law and is a requirement for transitions on the judicial systems. In the assessment of judicial independence, this study will pay a keen attention to the state of judicial independence between 1947 and 2007. The research will be primarily based in the literature discussing social movements as well as politics that has been judicialized (Dressel, 2018). This study will assess the challenge of judicial independence taking the recent controversial cases witnessed in Turkey and Pakistan. Problem Statement This study will uncover the underlying judicial independence while and do comparative analysis between Pakistan and Turkey as well as the impacts of social movements on such independence. The study also aims to determine the contributions that the judicial independence make in the political transitions. Research Question To achieve the objectives of this study, the following research questions will be answered. What are the impacts of social movements in judicial independence? 1. What types of social movements? You’ll need to get a lot more specific about that, as I’ll be looking for your theory to provide a clear explanation for why groups might effect independence. Honestly, I’d say that you just can focus on #1 from your research questions; trying to do all three is way too much for a single paper. Each of those research questions have literally dozens of books written about them. So I’d focus just on the one and start thinking about how to be more specific about what you mean (same goes for judicial independence – de jure or de facto?) 2. Why Pakistan and Turkey? Why not a broader selection of countries? You’ll either need to justify your case selection (based on your theory) or think about expanding the scope of the study. There isn’t anything that immediately jumps out at me and says you couldn’t do cross national research. For example, say you used the V-Dem measure of civil society in non-democracies, and then looked at how the pre-existing strength of civil society relates to judicial independence when a country transition to democracy. I’d need you to come up with a theory for how and why it would matter, but nothing there seems to suggest you couldn’t look more broadly. Something to think about. 3. Here is an annual review piece that might be useful: I. What are the “big” questions or topics this research engages with? II. Make sure the research question is stated clearly. a. Are all the concepts involved developed and defined, including consideration of the values the concepts can take across time and place? b. Is the author explicit about the hypothesized relationships among the variables included? III. Is the existing literature sufficiently reviewed, including defining the dimensions along which the literature is divided and the research designs employed? IV. Has the author explained very carefully how to move from conceptual dimensions to concrete indicators (. operationalization)? a. What are these good indicators and what are their possible pitfalls? b. Discuss their reliability and validity. V. What is the unit of analysis and how are the cases chosen? Given this sample, how generalizable are the findings? VI. Where were the indicators of the key concepts measured? a. What or who are the sources and how was the data gathered? b. Are there issues inherent to the data gathering techniques that should be discussed (. contamination, human subjects, etc.)? VII. Describe how the data was analyzed. VIII. What are the substantive conclusions drawn and are they appropriate given the data and analysis? IX. What are the big picture takeaways and contributions? How does this research connect to other readings from this week? What about previous weeks? X. What questions are suggested but not answered by this work? How might one expand on this research?
