Katherine Meller has worked as an English teacher at Constance Willard High School since 1 October 2014. The School has a Catholic ethos, and all staff who are in contact with the students are required to be practising Christians. When she joined the School, Katherine, a devout Catholic, signed up to the School`s mission statement which stipulated that staff should ‘set a high standard in their personal conduct and recognise that sexual intercourse should be enjoyed exclusively within Christian marriage`. Katherine is a lesbian and has a girlfriend, but kept her sexuality a secret as she feared losing her job if her colleagues found out. On 10 January 2022, a photograph of Katherine and her girlfriend holding hands at the Rumba Club, a local bar, was placed on the Instagram page of an anonymous account with the username ‘Tattle Central`. Following complaints from parents, the School`s Board of Governors decided to remove Katherine from her teaching position and to reassign her to a non-student facing role in the School`s library. Katherine accepted the reassignment, and because she no longer had much interaction with students and colleagues, began wearing a discrete pride flag pinned to her jacket. As a response, the School introduced a new dress code prohibiting the wearing of political symbols at work with effect from 15 February 2022. Katherine refused to comply with the new policy, arguing that a pride flag could not possibly constitute a political symbol. Katherine was dismissed with immediate effect on 17 February 2022. 1.
