VAPING
and the Loophole that allows vaping products to continue to be manufactured because they circumvent US Food and Drug Administration oversight of tobacco plant-derived nicotine by simply RE-labling them as “tobacco free,” because they introduced into them synthetic nicotine. Now, according to stakeholders like Parents Against Vapping E-Cigs, the US Food and Drug Administration needs to be granted authority to regulate these products and some in Congress seem to agree and seek to write such authoirty into legislation in the omnibus budget act (of congress!). So here we have a problem needing a law.
CEQA
a California law already existing that often gets weaponized in CALIFORNIA to combat growth and development (rightly and wrongly). Plaintiffs (“Save Berkeley Neighborhoods” ) who do not want development in their back yard (NIMBY) brought a law suit stating that UC Berkeley violated CEQA by increasing enrollment and students actually represent people-as-pollution. The State of California Supreme Court said in a 4-2 decision that UC Berekley failed to account for the impacts of increased student enrollment. We know that students and families already face anxiety about college decisions, we know that universities desire to admit new student and expand enrollment if they can do so. So to address the court’s decision, the legislature wrote legislation and the Governor signed it into law that removed CEQA’s provision that an increase in student enrollment by itself could be considered an environmental impact just like any other university project on the community. This incremental change does not mean that UC Berkeley does not have to meet environmental impact reviews, just that students alone cannot constitute an objection to development.
