1. Identify the problem– be sure to use details (AWARE)—These are the clues that have led to her being on trial for murder. 2. Appeal to you audience –know what your audience knows and use that! Remember, this happened in 1916. Do some research to see what life was like for women in 1916—keep in mind that women were not allowed to vote until 1919. Women could not wear pants, could not own property or a house. Also note that women were not allowed on juries, so the people on the jury would all be men. So, think about what your audience has gone through. Just synthesize the information about your jury and defendant in 1916, you do not need to cite it. 3. State your claim—that means you need to “take a side” As her defense lawyer or prosecutor, you need to clearly state your claim. Is she guilty or innocent? You must take a side. 4. Propose a solution- in problem solving, you need to make a decision. The solution is what should happen to Mrs. Wright. Should she be set free? Probation? Life in prison? Years? Death penalty? Or something else—you can be creative, but keep in mind it is 1916. It is up to you; you just need to be clear as to the solution. Think out your closing argument carefully—this woman is on trial for murder. 5. Persuade your audience that your solution is feasible and worthwhile—if you do not share with them that your solution will work, they will not follow you (AGREE). 6. End with a call to action. Let your audience know what they can do—give them a way to contribute and feel like they are part of the solution (ACT). At the end of your closing argument, you must ask the jury for their vote in your favor, so be sure to end with that. Use the format as a play, so if you are the Defense Attorney, you could either use your name, or write Defense Attorney. Use the play as an example or how I have laid it here for you below.
