George went out riding his snowmobile on a bright, cold and sunny February day. He took a trail he knew was very near a national park but did not worry about straying into the park. Quickly it got dark out and a ground blizzard started which blinded George and he soon got lost. His snowmobile then ran out of fuel. To save himself he built a snow-cave and was recused 24 hours later by a park ranger. It turned out that he had strayed into the national park in the storm. He was then prosecuted under section 16 USC 551 for using a motor vehicle on national park land without permission. How can George use the necessity defense to justify his actions and be acquitted of the crime? Explain the elements/requirements of the defense and if you think George has met these requirements.
