Who will you sue?
You ordered a Smart Tech remote control drone from Amazon for $300. You never received the drone. Amazon says it’s Smart Tech’s fault. Smart Tech says it’s Amazon’s fault.
Choose a defendant.
You are the plaintiff and defendant (feel free to make-up the information), addresses for the plaintiff and defendant.
Briefly state the facts that are causing you to sue this person: date the cause of action occurred, location of the cause of action, what occurred.
What is the cause of action – the legal reason you are suing the defendant (negligence, breach of contract etc.). Using Westlaw, research the elements of your cause of action and write each element. Write the fact that satisfies the element. (ex. one element of a contract action is for the plaintiff and defendant to have entered into a contract – Fact: Sue signed a contract on January 8, 2018 agreeing to pay John $5,000 for his 2007 Jeep when delivered on February 15, 2018.)
Will you bring your action in state or federal court? Why? Which level court will you bring it in? (Look at the first week’s Module).
