Discuss the implications of the SCOTUS decisions Nat. Fed. Of Independent Business, et al. v. Sebelius (2012); Burwell v. Hobby Lobby (2014)); Obergefell v. Hodges (2015); and Masterpiece Cakeshop v. Colorado Civil Rights Commission (2019) pertaining to various aspects of the constitutional limits of government power, including federalism, free speech, free exercise, etc. [You may wish to review as well Little Sisters of the Poor Saints Peter and Paul Home v. Pennsylvania, 591 U.S. ___ (2020)] Part of the exercise will be to identify the major issues concerned, though I anticipate all of you will deal with questions of federalism, the powers of the federal government; state police powers; first amendment liberties; and perhaps even unfunded mandates and the 10th amendment or federal taxation, its scope and nature, etc. I anticipate all of you will use Nexis Uni (formerly LexisNexis Academic) to do some real on-line legal research.
