This is a critical research essay analyzing the regulatory response to an urban planning policy challenge. The overarching question is: Is there a need for regulatory reform to address this policy challenge in Victoria? The approach you take to the question has deliberately been left open. However, relevant questions may include: How effective is the Victorian regulatory approach in achieving policy goals? Is this testable, or is there evidence supporting its effectiveness? How efficient is the Victorian regulatory approach? Does it impose an excessive or avoidable regulatory burden? What is the origin of the Victorian approach? Does the Victorian approach have a basis in research or empirical observation? Does the Victorian approach reflect best practice as seen in other jurisdictions (either Australian or international)? Are there lessons that can be learned from practice elsewhere? Does the Victorian approach allow for sufficient (or insufficient) opportunities for public consultation and democratic decision-making? Is the Victorian approach robust from an integrity perspective? Are there elements of the Victorian regulatory system – such as third-party rights, appeal processes, and the like – that require reform? How has the Victorian approach changed over time? What do different stakeholders say about the Victorian approach? What barriers exist to reform in this area? Note that it is unlikely in the scope of this essay that you will be able to address more than a couple of the above questions they are simply prompted for your approach to the overarching question, and you should not try to answer all these questions! It is understood that you may well not be able to present a definitive or certain viewpoint.
